Force Majeure
Force Majeure & Weather
In the world of project deadlines, timing is everything and in many industries, weather can be notoriously disruptive. In contract law, adverse weather is often stipulated under force majeure clauses in contracts. These clauses often specify varying thresholds for what is considered an “Act of God.” This is hardly standardized–often time these thresholds are agreed upon when drafting contracts. In a world where billion-dollar disasters are on the rise, we have seen a significant rise in force majeure disputes due to extreme weather events with many clients coming to us with questions. Our extensive experience as forensic meteorologists and access to a wide network of weather and climate data gives us the ability to do the following:
- Define what is considered “extreme” weather for the project, or projects, in question. This can vary from industry to industry.
- Prepare forecast reports in anticipation of disruptive weather.
- Prepare situation reports after disruptive weather events to determine whether conditions met force majeure criteria or not–preventing client arguments and potential litigation saves time and money!
- Serve as weather experts in litigious force majeure cases (provide expert reports and testimony)
With deep expertise in historical weather analysis, we ensure precision and reliability in every report, drawing from official weather data, radar scans, storm reports, and more.
